Terms of Service

These terms govern your use of Mailyte's hosted email service. By creating a workspace, you agree to them. If you're using our open-source community edition instead, the AGPL-3.0 licence applies, not these terms.

1. Your account

You’re responsible for keeping your credentials secure and for all activity under your workspace, including mail sent by teammates you invite. You must provide accurate information when creating an account and keep it up to date. You must be at least 18 years old, or the age of majority in your jurisdiction, to create a workspace.

2. Plans & billing

Paid plans are billed in advance, monthly or yearly, per mailbox. Upgrades take effect immediately and are prorated; downgrades take effect at your next renewal. Sending beyond your included allowance uses prepaid credits, which are purchased in advance — we do not bill you for going over. Fees are non-refundable except where required by law. We’ll notify you before any price change takes effect for your workspace.

3. Acceptable use

You may not use Mailyte to send spam, phishing attempts, malware, or any mail that violates the law where you or your recipients are located. Every broadcast you send must go only to people who opted in and must carry a working unsubscribe link. You may not attempt to circumvent rate limits, resell the service without authorisation, or interfere with the security or integrity of the platform. We may suspend a workspace that puts our deliverability or infrastructure at risk for other customers, with notice where practical.

4. Sending & deliverability

We provide tools to verify domain authentication (SPF, DKIM, DMARC) and monitor delivery, but we don’t guarantee that any individual message will be delivered or land in an inbox rather than a spam folder — inbox placement is ultimately controlled by the recipient’s mail provider.

5. Data ownership

Your mail and workspace data are yours. We don’t read it for advertising, sell it, or use it to train models — see our Privacy Policy for full detail. You can export everything at any time from Settings.

6. Open-source core

The engine behind the hosted service is released under AGPL-3.0. Running your own instance of the community edition is governed entirely by that licence, not by these terms.

7. Availability

We aim for high availability and publish live service checks on our status page, but the service is provided without warranty of uninterrupted or error-free operation. Scheduled maintenance will be announced in advance where possible.

8. Liability

To the maximum extent permitted by law, Mailyte is not liable for indirect, incidental, or consequential damages arising from your use of the service, including lost profits or lost data, beyond amounts you have paid us in the preceding 12 months.

9. Suspension & termination

We may suspend or terminate a workspace that violates these terms, with notice where practical and immediately in cases of serious abuse — for example, sending malware or illegal content. You may terminate your own workspace at any time from Settings.

10. Cancellation

Cancel any time from Settings — no cancellation fees. We’ll keep your data for 30 days after cancellation in case you change your mind, then permanently delete it.

11. Changes to these terms

We may update these terms from time to time. We’ll update the date at the top of this page and notify you by email or in-product notice for any change that materially affects your rights. Continued use of Mailyte after a change takes effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles, unless otherwise required by applicable local law where you reside.
